Government withdraws ‘phantom’ cases against Jagan

18th December 2012 09:18 AM

The state government on Monday dropped prosecution against Kadapa MP Y S Jagan Mohan Reddy and others in two cases dating back to the Samaikyandhra agitation in 2009. But if the Kadapa police are to be believed, the YSR Congress leader’s name had never figured in the FIR filed in the two cases and, therefore the question of dropping charges against him did not arise.
Asked how come, the Law Deparment and home minister Sabita Indra Reddy both shrugged their shoulders.
As per the state government’s decision to withdraw cases against people who took part in the pro-Telangana and Samaikyandhra agitations in 2009, R Damodar, secretary to the government (legislative affairs and Justice) issued two GOs on Monday, purporting to state that Jagan Mohan Reddy and other accused would not be prosecuted in the two cases.
As per the mystery GOs, one of the cases was registered by the Pulivendula (Urban) police station against 30 accused under Sections 143, 452, 353 and 436 read with Section 149 of the Indian Penal Code; another case was filed under Sections 3 and 4 of the Prevention of Damage of Public Property Act 1984 and Section 7(1) of the Criminal Law Act. In both these cases, as per the GO, Jagan is accused no. 30.
The charges were that the accused burnt a BSNL tower, set fire to a BSNL office, an MRO office and an R&B office. The cases were pending before the assistant sessions judge in Kadapa district.
However, when contacted by Express, the Kadapa police said there was only one case pending against Jagan in Pulivenduala and that was registered in 2011 and it has nothing to do with the Samikyandhra movement of 2009. “There are no such cases pending against Jagan in the Pulivenduala police station dating back to 2009,’’ a police official, requesting anonymity, said.
Elaborating, the source said, “We took legal opinion on dropping cases against 22 accused who participated in the Samaikyandhra agitation in 2009. The 22 names were sent to the government for process. Jagan’s name was not in that list.”
The Kadapa police official confirmed that there were three cases relating to the 2009 Samaikyandhra riots (191, 192 and 193 of 2009) in the Pulivendula Urban police station. They all relate to arson of government property. “Jagan’s name is not there in any of them,” said the source.
Asked how the list of 22 accused in the case ballooned to 30 in Monday’s GOs, law secretary R Damodar told Express that his staff only issued the GOs as per a request by the Home Department. Law Department staff had nothing to do with the names of accused, he said.
And the home minister passed the buck to the Police Department.

J factor and the journey to 2014

HYDERABAD

12th June 2012 08:12 AM

If the YSRC wins all 17 seats in Seemandhra its strength in the Assembly will rise to 19. With the support of  TRS (16)  it would then be in a position to move a no-trust motion against the Kiran Kumar Reddy government. The TDP will then be caught in a cleft stick. It may not support the motion, because that would amount to playing into Jagan’s hands. Supporting the Congress, and thereby propping its government, would be unthinkable. So the TDP would have to abstain, which would keep the Kiran Kumar Reddy government going.

If it succeeds in keeping its flock together, the Congress government will win the no-trust vote even if it wins not a single seat in Tuesday’s bypolls. However, the danger comes from potential J campers who may toy with the idea of switching loyalties, having watched the YSRC sweep the bypolls. Already two Congress MLAs have tendered their resignations to join the YSRC. If the more do so, there could be a stampede to the exits. Further, the presidential elections is coming up in July. YSRC MLAs and MPs are likely to vote against the UPA nominee. What if a certain number of Congress MLAs with Jagan sympathies declare that they too would vote against the UPA nominee? They would have to be disqualified, leading to another clutch of byelections further down the line.

Scenario 2:

YSRC WINS 10

If YSRC manages to win 10 seats in the bypolls, it may not be able to move a no-trust motion. Its strength in the Assembly will rise to only 13. Just one MLA is sufficient to give notice of a no-trust motion but when the notice comes up for voting on the floor of the Assembly, 10 per cent of the MLAs (29) would have to second it. If the YSRCP wins only ten seats, it may not try the no-trust motion manoeuvre. Even if it did as a propaganda exercise, the Congress government would be able to defeat it easily.

Scenario 3: YSRC WINS 6

If the YSRC wins six seats in the bypolls, the party’s strength would just be eight in the Assembly. It would have to try to unseat the Congress government by other means or sit tight until the 2014 general election. It may try to engineer further defections from the ruling party but its potential to do so would have diminished, not least because of the tribulations in store for Jagan in the CBI cases. In all likelihood in this scenario, the party will hunker down and build up its organisation in order to survive until 2014.

Scenario 4: YSRC WINS  3

If the YSRCP wins around three seats in the bypolls, the very existence of the party will be in trouble. With Jagan Mohan Reddy in jail, it could be difficult for his mother to run the party. The party has no strong organisational strength and has banked on the sympathy for Y S Rajasekhara Reddy. In such a situation, disintegration or survival as a rump party is a possible outcome.

Do YSRC, TRS have a secret deal in Andhra?

HYDERABAD: The alleged nexus between the YSR Congress Party (YSRCP) and the Telangana Rashtra Samithi (TRS) has become a subject of hot debate in political circles ahead of the by-elections in seven Assembly constituencies in the state.

There are allegations that the two parties have colluded with each other. The rumblings are more from the main opposition party, Telugu Desam (TDP), which sees TRS as a main threat in the Telangana and YSRCP in coastal Andhra and Rayalaseema regions.

What is the basis for the politicians to go to town on the alleged nexus?. They point out that TRS chief K Chandrasekhara Rao was in touch with YSRC party chief YS Jagan Mohan Reddy over phone. “Rao is seeking money from Jagan during his telephone talk,” TDP president N Chandrababu Naidu has alleged.

TRS activists obstructed the tours of Chandrababu Naidu in Telangana. They hurled eggs and stones on the convoy of Naidu. But TRS activists did not obstruct Jagan’s tour of Armoor in Nizamabad district where he undertook a two-day fast for farmers.

When Jagan held a similar dharna in Hyderabad some time back there was no opposition from the TRS. “All these prove that TRS and YSRC party have a secret understanding,” TDP leaders alleged.

Naidu has made another allegation that former minister Jupalli Krishna Rao, who resigned as an MLA and is contesting on TRS ticket was actually Jagan’s man. “Jupalli is a Jagan’s man. He joined the TRS and is contesting again. This shows the nexus between the YSRCP and TRS,” Naidu alleged.

On the other hand, TRS chief Rao declared that his party would extend support to the Andhra Rashtra Samithi (ARS) candidate in Kovur in Nellore district and campaign against the TDP there. Rao’s critics say that campaigning against the TDP means supporting the YSRCP.

“Casting a vote for YSRC party candidate is accepting the division of the state,” said minor irrigation minster TG Venkatesh, indirectly hinting that YSRCP and TRS have a nexus.

Some say that YSRCP did not field its candidates in the six constituencies in Telangana because of its understanding with the TRS. However, YSRCP leaders clarified that they were supporting the separate Telangana statehood demand and did not field their candidates against those MLAs who resigned in support of the statehood cause.

16 Jagan campers disqualified

HYDERABAD: In what could be termed as an unprecedented decision in the history of the AP Legislative Assembly, Speaker Nadendla Manohar on Friday night disqualified 16 MLAs of the ruling Congress who had voted against the government during a no-trust motion in December last year, sailing with Kadapa MP and YSR Congress chief YS Jagan Mohan Reddy. The Speaker also accepted the resignation of Praja Rajyam MLA B Sobha Nagi Reddy, who too had backed Jagan.

The surprise development has brought down the strength of Congress from 154 to 137 in the 294-member House but does not threaten the Kiran Kumar Reddy government, which still enjoys the support of 17 PRP members and seven of MIM. However, disqualifications of the MLAs is bound to stir up much political heat. It must be recalled here that Congress and PRP, had filed petitions on December 12, seeking disqualification of the 17 rebel MLAs for defying the parties’ whip and voting in support of the no-confidence motion brought by the N Chandrababu Naidu’s TDP on famers’ issues. Nadendla Manohar has finally acted on the petitions after almost two months.

Analysts felt that the notification for another round of byelections for the 17 seats which will be issued in due course, may turn out to be a mini-Assembly election. It may be noted here that bypolls to seven vacant seats are scheduled for March 18.
